Terms of Use of Rediff Partner Q & A (“Service”):
  1. Agreement:
    This Service is brought to you by Rediff.com India Ltd. ( “Rediff.com”) and its Alliance Partners subject to the following terms and conditions. The terms and conditions contained herein alongwith the Privacy Policy of Rediff.com form an Agreement under which this Service is made available to you. You are advised to read this Agreement carefully. If you are not agreeable to any terms and conditions, you should not accept them. You can use this Service if you are agreeable to all the terms and conditions of this Agreement in their entirety. You agree to abide by and bound by these terms and conditions. Rediff.com reserves the right to modify the terms and conditions ("Terms") of the Service and Disclaimer without any prior notification. You are advised to regularly review the Terms. If you do not agree with any of the Terms and any amendments thereto, you must not use this site/service. Rediff.com reserves the right to modify and alter the services at any time at its sole discretion without any notice to you.

    Rediff.com reserves the right to terminate this Service or your access to the Service either wholly or partly, at any time without any prior notification.

  2. Membership:
    Any person desirous of registering as a member is required to fill in the registration form as as prompted by the Service. Membership is non-transferable.

  3. Rights in Content:
    Members are solely responsible for everything contained in the questions/comments/ views/analysis/feedback/information/advice (collectively referred to as “Content”) uploaded/posted by them by way of queries or responses. Views expressed by members are their individual views and Rediff.com or its Alliance Partners are not responsible for any such views, expressions, ideas, comments, statements and content of the same.

    Rediff.com or its Alliance Partners does not claim any ownership in the content posted by you including without limitation the feedback and suggestions provided. However, by posting the content you represent and warrant that you either own or otherwise control all the rights in the content including but not limited to the intellectual property rights, right to post, upload, input or submit the content. By posting/ uploading the content you are granting Rediff.com or its Alliance Partners, its subsidiaries, affiliates a non-exclusive, royalty free, perpetual, worldwide license, unconditional and unfettered right to use the content posted by you including without limitation the right to adapt, copy, create derivative works based on, distribute, transmit, publicly display, publicly perform, reproduce, alter, edit, format, translate, store, view, sublicense and/or delete your content, without compensation to you or any other provider of the content. You also permit any user/anyone to access, display, view, store and reproduce your content for personal use.

  4. Members Conduct:

    4.1. You undertake and agree content shall not be unlawful, objectionable, false, misleading, illegal, objectionable, abusive, defamatory, harassing, vulgar, obscene, pornographic, contain viruses, indecent, libelous, racist, hateful, threatening, impersonating, enticing of minors, infringing of intellectual property rights, invasive of privacy or public rights or any other third party rights or otherwise injurious or objectionable, elicit response relating to illegal activity, is an expression of bigotry or hatred based on age, gender, race, religion, caste, class, lifestyle preference, and nationality, violate any applicable laws or regulations.

    4.2. You agree and warrant that you shall not use this Service either directly or indirectly to send/transmit any unsolicited bulk e-mail, junk mail or chain letters.

    4.3. You agree, understand and confirm that Rediff.com or its Alliance Partners are under no obligation to respond to any query posted by any user. The query posted by you may be answered by person(s) chosen by Rediff.com or by any user of this Service. Information received via this Service is intended for general information purposes and you further agree and confirm that said information is not intended/meant to substitute the professional advice. You further agree and confirm that the responses/information received from the Service may or may not be to your satisfaction /serve an intended purpose of yours.

    4.4. You may post the reply(ies) to any queries posted by any user, to express your views and ideas – this should not be done with the intent to misinform or at the cost of hurting the feelings of anyone.

    4.5. You understand and confirm that the query or responses posted by you falls under public domain and can be accessed by any one from anywhere and Rediff.com is under no obligation to maintain the confidentiality of the said content posted by you.

    4.6. You agree that this Service is made available to you for personal non-commercial use and you further undertake not to sell, use, reproduce, modify, alter, decompile, reengineer, edit, translate, transmit, copy, publish, perform, display or post any content without prior written permission of Rediff.com.

    4.7. You must use the Service in a manner consistent with any and all applicable local, state, Indian and International law and such other applicable laws, rules and regulations. Illegal and/or unauthorized use of the Service, including unauthorized framing of or linking to the Rediff Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.

  5. Rediff.com or its Alliance Partners reserves the following rights:

    5.1. Rediff.com or its Alliance Partners is under no obligation to monitor or review the content. Rediff.com or its Alliance Partners assumes no responsibility for the content, no obligation to modify or remove any inappropriate messages/content and no responsibility for the conduct of any user of this service. However, Rediff.com or its Alliance Partners reserves the right to review the content posted and to remove any content in its sole discretion.

    5.2. In the event that Rediff.com or its Alliance Partners receives a complaint that the contents posted by you infringe intellectual property rights or are otherwise unlawful, Rediff.com or its Alliance Partners shall request written substantiation of the complaint from the complaining party. As such, Rediff.com or its Alliance Partners will require substantiation of proof of ownership in the form of a trademark, service mark, patent or copyright registration and will take such steps that it believes to be appropriate under the circumstances.

    5.3. Rediff.com or its Alliance Partners reserves the right to terminate your access to the services at any time without any notice, without any liability, for any reason whatsoever, including if Rediff.com or its Alliance Partners believes that you have violated or acted inconsistently with the spirit of these Terms. However, the provisions of Sections 3, 5, 6, 7 and 10 shall survive any such termination.

    5.4. Rediff.com or its Alliance Partners reserves the right to release current or past member information that Rediff.com believes is in violation of the terms of service or page content guidelines, or used to commit unlawful acts, or if the information is subpoenaed, or a request is received from the law enforcement agencies or a court order and/or if Rediff.com or its Alliance Partners deems it necessary and/or appropriate.

    5.5. Member understands the Service is advertising supported and you grant Rediff.com or its Alliance Partners the right to disclose the aggregate Registration Data to third parties in connection with marketing the Services. Furthermore, Rediff.com or its Alliance Partners may itself use the members individual Registration Data to provide targeting of advertisements and other Service offers.

  6. Indemnity
    You agree to indemnify and hold harmless Rediff.com, its Alliance Partners, its affiliates, its employees, directors, officers, agents, persons chosen by Rediff.com to answer the queries and their successors and assigns from and against any and all liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising from or in connection with the contents posted/uploaded by you including any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other members and infringement of intellectual property or other rights.

  7. Disclaimer and limitation of liability:
    Members expressly agree and acknowledge that the use of the service is at their sole risk. The service is provided on an "as is" and "as available" basis. Rediff.com or its Alliance Partners expressly disclaims all warranties of any kind, whether express or implied. Rediff.com or its Alliance Partners makes no warranty that the services will meet the member's requirements, or the services will be uninterrupted, timely, secure, or error free; nor does Rediff.com or its Alliance Partners make any warranty as to the results that may be obtained through the service or that defects in the software will be corrected. Member understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the service is done at the member's own discretion and risk and member will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. Rediff.com or its Alliance Partners makes no warranty regarding any transactions entered into through the service. No advice or information, whether oral or written, which the member obtains from Rediff.com or through the service shall create any warranty not expressly made herein.
    Rediff.com or its Alliance Partners does not endorse in anyway any contents of the expression of the members. Please therefore verify the veracity of all content/information on your own before undertaking reliance and actioning thereupon. Rediff.com or its Alliance Partners shall neither be responsible nor liable for any consequential damages arising on account of the member relying on the contents. Rediff.com or its Alliance Partners shall not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data or lost profits arising out of or in connection with this service, even if Rediff.com or its Alliance Partners has been advised of the possibility of damages, or inability to use the Rediff sites/services or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through this services, or otherwise arising out of the use of the this services, whether based on contract, tort, negligence, strict liability or otherwise, even if Rediff.com or its Alliance Partners or any of its suppliers has been advised of the possibility of damages. Rediff.com or its Alliance Partners does not endorse in anyway any advertisers/ contents of advertisers on this service. Please therefore verify the veracity of all information/content on your own before undertaking reliance and actioning thereupon. Rediff.com or its Alliance Partners shall not be responsible nor liable for any consequential damages arising on account of your relying on the contents posted through the Services or any advertisement.
    Rediff.com or its Alliance Partners has made this service available to you as a matter of convenience. Rediff.com or its Alliance Partners expressly disclaims any claim or liability arising out of uploading of any content that is obscene, vulgar or pornographic, or altering or distorting the content available under this service in an obscene, vulgar or pornographic manner. You agree and acknowledge that you shall be solely responsible for your conduct and that Rediff.com or its Alliance Partners reserves the right to terminate your rights to use the service immediately, notwithstanding penal provisions under the Indian cyber laws or any other allied laws enacted by the government of India or any other statutory, legislative or regulatory authority authorized in this regard from time to time.
    Some jurisdictions do not allow the limitation of liability so some of the above limitations may not apply to you.

  8. Privacy Policy:
    All information provided by you or collected by Rediff.com or its Alliance Partners during your access to this service is governed by the Privacy Policy of Rediff.com which is hereby incorporated into these Terms by this reference. The terms and conditions of the Privacy Policy of Rediff.com for this Service shall supersede the terms and conditions of the privacy policy of Alliance Partners, if any.

  9. Miscellaneous:
    If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Rediff.com, its Alliance Partners with respect to these services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Rediff.com or its Alliance Partners with respect to these services. Rediff.com's or its Alliance Partners failure to act with respect to a breach by you or others does not waive their right to act with respect to subsequent or similar breaches.

  10. Jurisdiction:
    This agreement is governed and construed in accordance with the Laws of Union of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Mumbai, Maharashtra, India, in all disputes arising out of or relating to the use of these services. Use of these services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree to indemnify and hold Rediff.com, or its Alliance Partners its subsidiaries, affiliates, officers, directors, employees, and representatives harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on these services.
    Rediff.com's or its Alliance Partners performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Rediff's or its Alliance Partners right to comply with governmental, court and law enforcement requests or requirements relating to your use of these services or information provided to or gathered by Rediff.com with respect to such use.
